Terms
TERMS OF USE
Last updated: 2 November 2026
These terms are a contract between you and Going Out Out ("we", "us"), the operator of Going Out Out. The service name is Going Out Out. Our postal address is 13 Ernest Road, Portsmouth, PO1 5RB. Our email is contact@goingoutout.co.uk.
They apply if you browse the site, create an account, or list a venue. Please read them with the privacy notice and the cookie notice.
We do not sell tickets. We do not take payment on this site. A listing is information supplied by a venue or by us. It is not an offer of entry.
1. WHO MAY USE THE SITE
You may browse the public guide without an account.
You may create an account only if you are 18 or over, and you confirm that when you register. We do not ask for your date of birth. If we learn an account was opened by someone under 18, we will close it.
Member accounts and venue accounts are separate. A member account is for saving events, following pubs, and marking that you are going. A venue account is for listing and managing a venue. Signing in to one does not sign you in to the other.
You must give a real email address that you control. You are responsible for keeping your password confidential, and for activity under your account unless you have told us the account is compromised.
2. THE GUIDE
Going Out Out helps people find events, entertainment and venues, including in Portsmouth and Hampshire.
Listings can be submitted by venues and reviewed by us. We do not promise that every event in an area is listed, that a listing is complete, or that an event will go ahead. Times, prices, age rules and availability are set by the venue. Check with the venue before you travel, especially if the night matters.
A map pin is a guide. Distance is a straight line, not a driving route.
"Use my location" asks your browser for a point so we can suggest the nearest town. You can refuse. You can also type a town.
3. MARKING THAT YOU ARE GOING
When you mark that you are going, you are noting an intention. It is not a ticket, a reservation, a deposit, or guaranteed admission. The venue can refuse entry, sell out, or cancel.
We may show how many people have marked going. We do not show their names on the public page.
Favouriting a pub means we will email you when that pub adds an event, unless you have switched those emails off. Marking going means we will email you about changes, and send reminders, unless you have switched those emails off. You can switch them off in Alerts or by the link in the email. Details are in the privacy notice.
4. ACCOUNTS
You must accept these terms to open an account. We record the time and the version you accepted.
You must verify your email address to use the parts of the account that require it. Verifying an email address proves you can read that inbox. It does not prove that you own, manage, or represent a venue.
You can download a copy of your profile, saved events, going marks and followed pubs from your account. You can ask us to delete the account from your account. We deal with deletion in the privacy notice.
We may suspend or close an account if you break these terms, if we reasonably believe the account is being misused, or if the law requires it. We will tell you unless doing so would cause harm or break the law. You may close your own account by asking for deletion.
5. VENUE LISTINGS
A venue account can submit a listing and events. We may approve, reject, edit for clarity, or take down a listing. Approval is not a statement that we have inspected the premises, the licence, or the event.
You promise that:
- The details are true, current, and not misleading.
- You have the right to list that venue. If the venue is already listed, claim it instead of creating a duplicate.
- You will not upload a photograph, logo, or description you do not have permission to use.
- You will not publish a person's private contact details, or a photograph of a child, unless you have a proper reason and the right to do so.
- Events, prices, age limits and booking links are accurate, and you will correct them when they change.
- The listing and the event comply with the law, including licensing, equality, consumer protection, and advertising rules.
- You will not use the listing to sell anything this site does not provide, including tickets sold as if we were the box office.
Email verification and an approved listing do not prove legal ownership of the premises. If there is a dispute about who controls a listing, we may pause it until the people involved sort it out, and we may ask for evidence.
You keep ownership of the text and images you upload. You give us a non-exclusive licence to host, reproduce, adapt for layout, and display that material for as long as the listing is on the site and in backups for the period in the privacy notice. You can end the licence for future display by removing the material or closing the listing, subject to backups and to any copy another visitor has already shared.
Featuring is optional. Asking about featuring sends an enquiry. There is no checkout and no price on the site. Nothing is featured, and nothing is payable, unless we agree that separately in writing.
Staff you invite must also be 18 or over and must have their own venue account. You are responsible for who you invite and for removing people who should no longer manage the listing.
6. ACCEPTABLE USE
You must not:
- Break the law, or encourage someone else to.
- Post anything defamatory, harassing, hateful, obscene, or discriminatory.
- Infringe someone else's intellectual property or privacy.
- Pretend to be a venue, a person, or us.
- Scrape, overload, or probe the site in a way that degrades it for other people. Ordinary browsing and normal search-engine indexing are fine.
- Attempt to gain access to another account, or to the admin area.
- Upload malware, or interfere with security.
- Use the site to send unsolicited commercial email.
- Collect personal information about visitors, including people who marked going. You only see a count.
We may remove content, refuse a listing, or suspend an account that breaks this section. We may keep a report, and the outcome, as described in the privacy notice.
If you see a listing that is wrong or harmful, use the report control or email. [contact@goingoutout.co.uk]
7. OUR CONTENT
The Going Out Out name, wordmark, design, and the text we write ourselves are ours, or are used by us under licence. You may share a link to a public page. You may not copy the site's design or present the guide as your own product.
Event information is for personal use. Venues may use it to manage their own listing.
8. OTHER SERVICES
A booking link, a website, a social profile, a share button, a map tile and a font file can take you to someone else's service. We are not responsible for their content, their charges, or their privacy practices. Read their terms before you buy or hand over information.
We do not take payment for tickets or for entry. If you pay a venue or a ticket seller, that contract is with them, not with us.
9. LIABILITY
Please read this section. It sets out what we are each responsible for.
What we do not exclude
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that the law of the United Kingdom does not allow us to limit or exclude.
If you are a consumer, you also keep your statutory rights. These terms do not take away rights under the Consumer Rights Act 2015. A service supplied to a consumer must be performed with reasonable care and skill.
What you acknowledge
Events are run by venues and organisers, not by us. We are a directory. We are not the organiser, the licensee, or the box office, unless we say in writing that we are.
To the extent the law allows:
- We are not responsible for a venue cancelling, changing, selling out, refusing entry, or describing an event inaccurately, where that came from the venue and we did not cause it.
- We are not responsible for loss that was not a foreseeable result of our breaking these terms. Loss is foreseeable if it was an obvious consequence, or if both of us knew it might happen when the contract was made.
- We are not responsible for loss of profit, loss of business, or loss of goodwill, where you are using the site as a consumer for a night out. If you use a venue account in the course of a business, we are not responsible for those business losses, whether direct or indirect.
Business users
If you use a venue account in the course of a business, then, apart from the liabilities we cannot exclude, our total liability to you in any 12 month period is limited to £100. The site does not charge a listing fee. This cap is a fair reflection of a free listing tool. It does not apply to liability we cannot legally limit.
Consumers
If you are a consumer, we do not put a fixed cash cap on liability for our own breach. We are not liable for losses that are not foreseeable, as set out above.
10. YOUR RESPONSIBILITY TO US
If you list a venue, you will cover us against claims, costs and reasonable legal fees that come from your listing, your event, or your breaking these terms, except to the extent the claim was caused by our own breach or negligence. This does not apply to a person who is using a member account only as a consumer.
11. ENDING THE CONTRACT
You may stop using the site at any time. You may ask us to delete an account as described in the privacy notice.
We may stop providing the site. If we close it for good, we will give registered account holders as much notice as we reasonably can by email.
Sections that by their nature should continue, including liability, acceptable use for content already submitted, and the licence for material still in backups, continue after the contract ends.
12. CHANGES TO THESE TERMS
We will post the new terms on this page and change the date. If you have an account and the change is material, we will email you. If you do not agree, stop using the account and ask us to delete it. If you keep using a member or venue account after the date we told you the change starts, the new terms apply to that use.
A change never reduces a consumer right that the law says we cannot take away.
13. LAW AND DISPUTES
These terms are governed by the law of England and Wales.
The courts of England and Wales will deal with disputes. If you are a consumer living in Scotland, you may also bring a claim in Scotland. If you are a consumer living in Northern Ireland, you may also bring a claim in Northern Ireland.
Nothing in this section stops you complaining to the Information Commissioner's Office about personal information, or using any other official scheme you are entitled to use.
Please email [contact@goingoutout.co.uk] first and give us a chance to put the problem right.
14. WHOLE AGREEMENT
These terms, the privacy notice and the cookie notice are the agreement for use of the site. They replace earlier versions from the date at the top. If a court finds one sentence unenforceable, the rest stays in force.
If we do not enforce a right straight away, we can still enforce it later.
